Title insurance provides a warranty on the seller's title. Attorneys are only liable for negligence, and many of today's issues - like forgery or duress - are not readily evident during a title exam. Title insurance shifts the burden from the attorney (and lender) to the insurer.


For an owner, coverage lasts for as long as that party owns the property. For a lender, coverage lasts for the life of the loan. This is after a modest, one-time premium, without any recurring fees, and doesn't expire.


The lender won't always require one, but it's generally a good idea. The lender will typically enjoy coverage within their policy without a survey, but there isn't a better tool to reveal potential title impacts (like encroachments or setback problems). An owner's policy specifically excludes coverage for a matter that would have been disclosed by a current survey.
